Arrival & Departure times:  Check in time is 4:00PM and check out is 10:00AM. Due to a need to professionally clean the Property, Check-in and Check-out times must be strictly enforced.  Check in before the Arrival time or check-out after the departure time will incur an additional full day’s rent. If you would like to extend your stay, please contact Sergio or Janine.

Guest registry: The use and occupancy of the Property is limited to the named Renter and Guests (max 6).  The six registered Renter and Guests on the Rental Agreement are the only overnight guests allowed, unless prior written permission is received from owners.

The Renter signing this agreement must be at least 25 years of age and will be held responsible for all other Guests of the Renter for compliance with this Agreement, with listed policies, ordinances, rules and regulations and for any losses incurred by Owner or to the property due to negligence of vandalism.  All Guests must read the Rules, Regulations and Rental Rate notices posted at the Property.

Occupancy limit:  the maximum number of overnight guests allowed at the property at any one time is (6).

Parking:  the property is a private home, parking will be permitted in the driveway and carport only with a limit of (3) cars. 

Children:  we allow children age 7 and up.  We suggest renters purchase damage insurance to protect your security deposit in case there is any damage or broken items.

Smoking:  smoking is strictly forbidden inside the house.  Evidence of smoking inside will result in additional cleaning fees to Renters as Excess damage cost and will be deducted from the deposit and will result in immediate eviction.  Smoking is allowed outside downstairs only. All cigarette butts are to be removed from the property.

Included in rental rate:  electricity, water, sewer, cable and initial supplies (one-week supply of toilet paper, paper towels, dish soap, laundry detergent, hand soap, dishwater detergent and garbage bags).

Utility caps: Utility bills are capped at $150 for water and $150 for electricity per month. If the final bill is above this amount, the renter is responsible for the difference and the overage will be deducted from the security deposit, a copy of the bill will be provided.

No Pets are allowed:  unless prior arrangements are made. If there is any pet damage or smell of urine, a cleaning fee will be deducted from the security deposit.

Bicycles:  are available to renters to use during their stay including two bikes, helmets and tire pump.  Please leave them in the same location when you depart.

Kayaks and Stand Up Paddle Boards:  a single and pedal kayak and two stand up paddle (SUP) boards are available for you to use during your stay. Boards and paddles are located on the dock on a stand and the life vests are in the white dock box. Please rinse with the hose and leave them in the same location when you depart.  Children under age 12 are required to wear life vests, and for age 12+ you must have them with you on the board, but do not have to be worn.

Barbeque: Owners ask that Renters act sensibly and responsibly with the use of the gas grill. There is a second propane gas tank in the white storage container next to the AC unit in case the first one runs out.

Jacuzzi:  the jacuzzi stays on and is set at 102 degrees F.  Please place one bromine tablet in the Jacuzzi once a week to keep it clean.

Kitchen & Bar:  our kitchen is well stocked with condiments and spices, you are welcome to use them for your cooking purposes.  We also have some mixers and spirits in the bar that if consumed, we just ask that you replace them.

Fire extinguishers/ First Aid:  There are fire extinguishers located upstairs in the laundry room off the kitchen and downstairs in the bar-be-que area.  There is a first aid kit in the bottom drawer of the guest bathroom and in the garage.

Use of Water: Water is scarce and costly in the Florida Keys. It is pumped in through a 130 mile long transmission pipe from Florida City.  We ask that you please help us to conserve water and use it wisely while you shower, wash dishes or do laundry.

Air conditioning:  You will find the house very comfortable set to 76 degrees with the fans on, you may even choose to open the windows January to March.  When you depart, please make sure the AC is set to 78 degrees.

Trash Collection:  Trash pick-up is on Mondays and Thursdays, please put out all garbage in garbage to the curb the night before (pick up is early) and bring cans back in the next day. Pick up for yard clippings and blue recycled bins are on Saturday morning. If Palm fronds fall during your stay and are in your way, you can place them in front of the garage or side of the house.

Noise ordinance(s):  The Property is located in a neighborhood which has a “noise ordinance” in effect after dark.  All Guests agree to respect the Noise Ordinance and to use common sense in keeping noise volume low after dark. Any police enforcement actions by the County or other home owners may result in excess damage costs and/or immediate eviction and forfeiture of all amounts paid.

Cleaning:  It is the responsibility of the Renters to leave the Property in reasonably clean condition and to remove all personal items and trash. Renters shall clean all dishes (or run dishwasher) prior to leaving, bag and remove the garbage from inside the home to the garbage cans and wash any used/wet towels. You can leave the linens on the beds for housekeeping to wash.

Damages and Missing items:  Renter assumes full responsibility for any items found to be missing or any damage due to misuse, negligence or action on Renters or Guests, except in the case of normal wear and tear reported to the Owners within 48 hours of Check-in. Damage will be accessed at replacement value and deducted from the security deposit. Renters may want to consider purchasing optional renters insurance.

Repairs and maintenance: Repair and maintenance problems must be brought to theowner’s attention within 48 hours of occupancy or occurrence or Renters will be held liable for all such damages or repairs. Owners will not be responsible for any unauthorized expenses incurred by Renter or his/her Guests.  Costs of needless or unauthorized service will be charged as Excess Damage cost against the security deposit being held.

Casualty or Destruction:  should the Property be destroyed or rendered uninhabitable by an Act of God (including, but not limited to hurricanes, storms, floods or fire) or by environmental disaster, prior to occupancy by Renters, this Agreement shall become null and void, and all payments made hereunder shall be refunded to Renters in full.  Should the property be destroyed or rendered uninhabitable as above during occupancy, reimbursement on a pro-rated basis will be negotiated between Renter and Owner.

Liability and Damage:  Renter agrees to defend, indemnify and hold Owner harmless from any and all liability, claims, loss, property damage or expenses, arising by reason of any injury, death or damage sustained by any person, or to the property of any person, in or on the Property during the Term of this Agreement, including Guests, additional invitees or visitors of Guest, where such injury, death is caused by a negligent or intentional act of Guest, additional guest or any of Guest’s visitors or invitees.

Indemnification and Insurance:  Renter agrees to indemnify and hold harmless Owner of the Property against all loss, damage, expense and penalty arising from any action of the Renter or Guests which causes injury or death to any person or damage to any property. Renter is encouraged to secure the appropriate travelers damage and vacation insurance.

Cause for eviction: The Renter and all Guests will be subject to immediate eviction from the Property if the Renter or Guests violate any terms of this agreement, including but not limited to, violation of the occupancy limits, pet provision, smoking, noise ordinance or parking.  In the event of eviction from the Property, the Renter shall forfeit all amounts paid and there will be no refund of money.

Attorney’s Fees and Costs:  if Owner employs the services of an attorney to enforce any condition of this Agreement, to collect any amounts due, the eviction of the Renter, or because Renter takes any action to recover deposits not due, Renter shall be liable to Owner for reasonable Attorney fees and costs incurred by Owner.

Short-Term Rental:  It is expressly understood and agreed that this is a short-term vacation rental under the provisions of Chapter 509, Florida Statutes, and is not a lease or other long term residential tenancy agreement.  This Agreement is only for the licensed use of the Property for the stated Term. It creates no property rights in Renter and no rights to renewal or for recurring usage. This Agreement is also neither a Time-Share sale or a Plan of Time-Share Development, nor a Vacation Club.

Falsified Reservations:  Any reservation obtained under false pretense will be subject to forfeiture of Reservation Deposit and Final Balance, if paid, and such party will not be permitted to check in and/or will be subject to immediate eviction with the forfeiture of all amounts paid.

General Terms: This Agreement is made in, and shall be governed solely by the laws of, the State of Florida and Chapter 509, Florida Statues. If any section, clause, paragraph or term of this Agreement is held of determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. This Agreement is taken in full compliance with federal, state and local Fair Housing Laws, without regard to race, color, religion, sex, country or origin, handicap or familial status. Renter and Guests are to be mindful that this Property is located in a residential neighborhood. Renter and Guests are expected to be courteous to residents and guests, to be respectful of the rights of others, and to not be noisy.

Succession, Assignment:  This Agreement is binding on, and the benefits inure to, the heirs and personal representatives of the parties. However, neither this agreement nor any rights hereunder may be assigned (in whole or in part) by Renter.
